Earlier this year, the General Data Protection Regulation (GDPR), (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data) was published in the Official Journal. On 25 May 2018 we will all be obliged to comply with this Regulation which replaces the UK Data Protection Act 1998. No matter when or if we Brexit, it will be after the GDPR becomes law in the UK.
With the current focus on Brexit, it is not surprising that we are still awaiting guidance from the UK's Information Commissioner and other bodies as to how the GDPR will work in the UK. What is certain is that brokers will need a greater command over the data they hold, why it is held and for how long it is held.
